These Terms of Service ("Terms") govern your use of VibeCRM's customer relationship management platform and related services. By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
1.1 Agreement to Terms
By creating an account, accessing, or using VibeCRM services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our services.
1.2 Eligibility
- You must be at least 18 years old to use our services
- You must have the legal capacity to enter into binding agreements
- You must not be prohibited from using our services under applicable laws
- If using on behalf of an organization, you must have authority to bind that organization
2. Description of Services
2.1 VibeCRM Platform
VibeCRM provides a cloud-based customer relationship management platform that includes:
- Contact and lead management
- Sales pipeline tracking
- Email integration and automation
- Reporting and analytics
- Third-party integrations
- Mobile applications
- API access
2.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will provide reasonable notice of material changes that affect your use of the services.
3. User Accounts and Registration
3.1 Account Creation
- You must provide accurate, complete, and current information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- You are responsible for all activities that occur under your account
3.2 Account Security
- Use strong, unique passwords for your account
- Enable two-factor authentication when available
- Do not share your account credentials with others
- Log out of your account when using shared or public devices
4. Acceptable Use Policy
4.1 Permitted Uses
You may use our services for legitimate business purposes, including:
- Managing customer relationships and sales processes
- Storing and organizing business contacts and data
- Automating business workflows and communications
- Generating reports and analytics for business insights
4.2 Prohibited Uses
You may not use our services to:
- Violate any applicable laws, regulations, or third-party rights
- Send spam, unsolicited communications, or engage in illegal marketing practices
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse engineer, decompile, or attempt to extract source code
- Use our services to compete with us or develop competing products
- Store or transmit illegal, harmful, or offensive content
5. Data and Content
5.1 Your Data
- You retain ownership of all data you upload to our platform
- You are responsible for the accuracy and legality of your data
- You must have proper rights and permissions for all data you upload
- You must comply with applicable data protection laws
5.2 Data Backup and Recovery
While we maintain regular backups of our systems, you are responsible for maintaining your own backups of critical data. We recommend regularly exporting your data as an additional precaution.
6. Payment Terms
6.1 Subscription Fees
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as expressly stated in these Terms
- Prices may change with 30 days' notice to existing customers
- Taxes are additional and will be added to your invoice where applicable
6.2 Payment Processing
- Payment is due immediately upon invoice
- We accept major credit cards and ACH transfers
- Failed payments may result in service suspension
- You are responsible for keeping payment information current
7. Service Level Agreement
7.1 Uptime Commitment
We strive to maintain 99.9% uptime for our services, excluding scheduled maintenance windows. Downtime credits may be available for extended outages as outlined in our SLA documentation.
7.2 Support
- Email support is available to all customers
- Priority support is available for premium plan customers
- Support hours are Monday-Friday, 9 AM - 6 PM PST
- Emergency support is available for critical issues
8. Intellectual Property
8.1 Our Rights
VibeCRM and all related trademarks, logos, and intellectual property are owned by us. You may not use our intellectual property without our express written permission.
8.2 License to Use
We grant you a limited, non-exclusive, non-transferable license to use our services in accordance with these Terms. This license terminates when your subscription ends or these Terms are terminated.
9. Limitation of Liability
To the maximum extent permitted by law, VibeCRM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.
10. Termination
10.1 Termination by You
You may terminate your account at any time by canceling your subscription through your account settings or contacting our support team.
10.2 Termination by Us
We may terminate your account immediately if you violate these Terms, fail to pay fees, or engage in prohibited activities.
11. Governing Law
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Seattle, Washington.
